The case relates to an appeal against the refusal of planning permission for a proposed barn conversion. Mr and Mrs J. Eagles (E) applied to quash a decision of the Minister for the Environment, Sustainability and Housing, Welsh Assembly Government, through an inspector, to refuse to grant them planning permission to convert a barn to ancillary use to a listed farmhouse. Torfaen County Borough Council (T) had refused to grant planning permission and the inspector upheld that decision. He considered that the proposed conversion would fail to preserve the character and setting of the listed building, and would result in a separate accommodation which was not ancillary to the farmhouse. E argued that the inspector failed to take into account the functional relationship of the development to the farmhouse and erred in considering ancillary use and in not considering the history of the listed building and the brick extension. "Held": Application refused. The inspector had taken into account the scale, size, and physical layout. He also considered that the extension would constitute a self-contained house not linked physically to the farmhouse and would afford those living in it the facilities necessary for private independent existence.
