Discusses the increased use of damage payments to settle breaches of legal rights. Describes the three types of awards available: compensatory, buy-out and account-for-profit damages. The award of the buy-out price is considered and criteria which have been used for assessing its level are discussed. Argues that this area of law is in need of reform and that the arbitrary measures used are undermining confidence in the system. Case law.
