In depth analysis of the Housing Grants Construction and Regeneration Act 1996 (HGCR) s107, the provision concerned with construction contracts in writing. Examines the HGCR Act s107(2), s107(3), s107(4) and s107(5) with reference to key case law. Illustrates that the 'in writing' requirement is not literal and s107 allows for an agreement to be deemed to be in writing in circumstances in which it is not actually in writing.
