QBD 4 May 2001. Examined the issues of whether the notice terminating tenancy addressed to an ex-tenant was a valid notice, whether the tenant was entitled to Rent Act protection and fair rent limit and whether the rent assessment committee was entitled to determing rent above the £25,000 limit. Application was dismissed. Held that the notice sent in 1995 was invalid; the clamaint's tenancy was now a 'long residential tenancy' subject to the Local Government and Housing Act 1989 sched 10. Referring to Schedule 10 para 10(5) it was decided that the rent assessment committee could determine a rent above the £25,000 limit.
