Summary: This code is approved by the Secretary of State for England under the terms of the Leasehold Reform, Housing and Urban Development Act 1993 S87. It was first published in 1997 and the Code has been updated to incorporate the provisions of the Commonhold and Leasehold Reform Act 2002 (where implemented). The Code has been prepared to promote good practice in the management of residential leasehold property where a service charge is payable and the landlord is not a public sector authority or Registered Social Landlord. It does not apply to commonhold. Readers of this Code will note that it contains many references to the Commonhold and Leasehold Reform Act 2002. It should be noted that some sections of this Act have not, as yet, been implemented. It is understood that further sections of the Act may be implemented during 2009. RICS expects to issue updates to the Code in order to reflect any such changes.
