Highlights some of the issues that should be considered by landlords considering the creation of a new store or stores from existing units or common areas in shopping centres. These include: whether or not the landlord has the right to carry out such works; if these would interfere with the tenants' reserved rights; if they would adversely affect other tenants' business and how; and the need to obtain possession, even where the tenant is insolvent. Concludes that landlords must pay utmost attention to the tenants' needs in order to meet the obligations that are implicit in the relationship between landlord and tenant. Refers to recent case law throughout.
