The Mayor and Burgesses of the London Borough of Hounslow v Minchinton - 1997 - Property, planning & compensation reports [1997] 74 P&CR 221-234(14) .

CA 19 March 1997. Dispute over possession of strip of land at the bottom of the appellant`s garden. Appellant believed she had acquired title by adverse possession and had proceeded to build a summerhouse partly on that land. The Judge found that the garden had been enclosed throughout the ownership of the appellant and her predecessor in title, but held that she had failed to establish title to any part of the strip. The CA allowed her appeal, saying it was sufficient for a claim to title by adverse possession that she or her predecessors had been in adverse possession of the land for 12 years, whereupon the title of the true owner would be extinguished.
